Greetings from MDSKorea.
Overview
The Council of the European Union announced that it has reached a provisional agreement1) with the European Parliament regarding the management and funding of ECHA2).
Since its establishment in 2007 under REACH, ECHA's responsibilities have continuously expanded into product safety and environmental fields, including restriction policies on microplastics and PFAS(Per- and polyfluoroalkyl substances). The core of this agreement is to decouple ECHA from the REACH regulation and establish an independent legal framework.
1) European Chemicals Agency. The EU agency implementing chemical regulations such as REACH.
2) A draft agreed upon by the Council and the Parliament during trilogues, prior to formal adoption.
*Trilogue: Tripartite negotiations between the European Commission, the Council, and the Parliament.
Key takeaways
According to the announcement by the EU Council, the agreement includes the following four key points.
1. Consolidating ECHA's tasks in one place
Previously, ECHA's duties and responsibilities were scattered across various laws; they will now be consolidated under a single regulation and decoupled from REACH. Moving forward, the European Parliament or member states may directly request scientific opinions from ECHA after consulting with the European Commission.
2. Operating the structure more flexibly
ECHA's organizational structure has been adapted to better manage its growing workload, and experts nominated by member states have been appointed to the Risk Assessment Committee (RAC)3) and the Committee for Socio-Economic Analysis (SEAC)4).
3) A scientific committee under ECHA, consisting of experts nominated by member states.
4) Another scientific committee under ECHA alongside RAC, similarly composed of experts nominated by member states.
3. Simplifying the budget management system
Budgets that were previously divided into three have been unified into a single autonomous budget.
Additionally, to stably prepare for highly volatile annual fee revenues, a reserve fund system has been newly established, allowing up to 10% of the revenue to be set aside.
*In this process, the European Commission may adjust this reserve ratio between 1% and 20% to better reflect ECHA's actual financial situation.
4. Establishing measures to safeguard credibility
Relevant rules have been refined to ensure that ECHA staff and internal committee members work fairly without conflicts of interest, thereby enhancing the agency's independence and credibility.
Conclusion
The provisional agreement now only awaits the formal adoption process by the European Parliament and the Council. Once adopted, it will be published in the Official Journal5) of the European Union and will enter into force 20 days after publication.
Although formal adoption and publication procedures still remain and it is not yet officially in effect, please note that this may influence the speed of ECHA's chemical assessments and restrictions in the future.
5) Official Journal of the European Union. The official gazette for publishing EU legislation.
MDSKorea will always strive to provide you with useful information. Thank you.
