[Regulation]Regulation update: The EU Commission adopts major changes to RoHS lead-related exemptions

On September 8, 2025, the European Commission finalized delegated directives amending Annex III of the RoHS Directive (Restriction of Hazardous Substances, 2011/65/EU). These directives are expected to enter into force in late 2025. 


Overview of EU RoHS

  • Aims to regulate hazardous substances in electrical and electronic equipment (EEE) to reduce environmental pollution and risks to human health arising during manufacturing, use, and end-of-life stages.

  • First introduced in 2003, subsequent amendments have expanded the scope of products covered, increased the number of restricted substances, and tightened exemption provisions

    • Scope (Article 2 & Annex I): Applies to most electrical and electronic equipment, excluding specific uses such as military, aerospace, large-scale industrial equipment, and certain medical applications.

    • Restricted Substances (Annex II): 10 (Pb, Hg, Cd, Cr⁶⁺, PBB, PBDE, DEHP, BBP, DBP, and DIBP).

    • Exemptions (Annex III): Provisions allowing temporary relaxation of restrictions when the use of restricted substances is unavoidable or technically difficult to substitute.

    • Addition of new exemptions (new categories)

    • Phase-out of certain exemptions (revoked)
      Note: Revoked exemptions with designated phase-out periods are not eligible for renewal

  • Renewal of expiry dates for existing exemptions
